
New Delhi: A Delhi court recently directed the desealing of three floors of a building in the basement of which three UPSC aspirants drowned due to rainwater flooding in July 2024 in Old Rajendra Nagar.
The court of principal district and sessions judge Anju Bajaj Chandna allowed petitions filed by Gurpreet Singh (owner of the second floor) and Rishi Khanna (owner of the ground and first floors) seeking the desealing of the floors they own.
The court stated that the floors in question were not directly involved in the crime, as the incident happened in the basement. “I do not find any legal provision which allows CBI to take control of the property indefinitely, particularly when the same is not involved in the crime in question. In my opinion, revisionists should be allowed to deal with his property and the same be released to him,” the judge ordered.
The court, however, made it clear that this order would not prevent the authorities concerned from taking any action against the building in question in case of violation of rules, regulations, or bylaws.
The petitioners challenged the trial court order dated Dec 17, 2024, in which their prayers to deseal their floors and free ingress and egress were rejected. The counsel for the father of one of the deceased opposed the application and submitted that the building was constructed without a building sanction plan.
After the incident, an FIR was registered at the Rajendra Nagar police station and later, by orders of Delhi High Court on Aug 2, the investigation was transferred to CBI.
