HC fines woman for instigating husband | Delhi News – The Times of India

New Delhi: Delhi High Court recently imposed costs of Rs 50,000 on a woman who filed a petition against her estranged husband and his parents, alleging that they created a ruckus during child visitation.
The division bench of Justices Navin Chawla and Renu Bhatnagar found that the woman had instigated the husband, forcing him to react the way he did.
The woman approached the court, claiming the husband and his parents committed contempt of court by creating a ruckus when they came to visit the child.
The bench observed that the woman also recorded a video of the incident during the visitation hours. After watching the video, the court found that it was she who violated the orders passed by a family court and instigated the husband.
“On watching the video, it is our considered opinion that, in fact, it was the petitioner and persons along with her who were instigating the respondent no. 1 (the man) into reacting in the way he did,” the bench said.
The bench, observing that in the video, the mother of her husband even tried to request the persons accompanying the wife not to mock and to allow the visitation to take place peacefully, noted, “However, this request, as is apparent from the video, was again mocked at.”
The court, dismissing the contempt of court petition, said: “We further direct the petitioner to pay a cost of Rs 50,000, out of which Rs 25,000 shall be paid to respondent no. 1, while the remaining Rs 25,000 shall be deposited with Delhi High Court Advocates Welfare Fund, within a period of four weeks from today.”
