Man ‘forces’ daughter to file false rape case | Delhi News – The Times of India

New Delhi: A court has directed Delhi Police to register an FIR against a man for pressuring and mentally abusing his 17-year-old daughter to file a false Pocso case against his relatives to settle a personal score.
The court of additional sessions judge Anu Aggarwal, in an order dated April 3, directed the FIR under Section 22(1) (false complaint or false information) of Protection of Children from Sexual Offences Act against the father.
“This case is a classic case which shows how the complainant’s father misused the provision of law not only to settle his personal score with his relatives but also to deter the advocate, whose only fault was that he was giving his professional services to those relatives,” it observed. “By forcing her (daughter) to file the false complaint, he also caused mental agony to the complainant,” the judge said.
Additional public prosecutor Arun KV told TOI that this was among the first cases in India where such an FIR was registered.
The court was hearing a case alleging that the minor’s maternal relatives and an advocate had molested her. The judge noted that the investigating officer submitted a closure report, showing that a false case was registered. Accepting the closure report, the court directed the station house officer concerned to register the FIR.
The court pointed out that the “benevolent Pocso provisions” meant to check the alarming rise in child sexual abuse cases and protect children from heinous offences were being misused, posing “a serious threat to society in general and to the entire justice delivery system, in particular”. “It is because of such litigants that even genuine cases are looked upon with suspicious eyes by the general public.”
