
New Delhi: A Delhi court has granted anticipatory bail to a man accused of attempted murder and possessing illegal arms, noting that the “sword of impending arrest… cannot be kept hanging over the accused for an indefinite period.”The case involves a property disputebetween the accused, Dilbagh Rana alias Billu, and the complainant, Akhilesh Tiwari. Tiwari alleged that on Oct 28, 2024, Rana and his associates arrived at a Siraspur property armed and opened fire with the intent to kill. Tiwari claimed to have escaped and recorded the incident on video.However, the court, presided over by Additional Sessions Judge Viplav Dabass, observed that the video footage did not show any firing, casting doubt on the incident’s description and the application of attempted murder charges under Section 109 BNS.The court noted that Rana had no previous criminal record, and two co-accused were released on bail within 24 hours.The investigating officer confirmed no further recovery was needed from the accused and that he had cooperated fully.Rana was granted bail on furnishing a personal bond of 40,000 with one surety. Among other conditions, he is to refrain from tampering with evidence or contacting the complainant.Rana’s legal team—Advocates Sahil Rao, Rahul Yadav, and Sharukh Sharma—argued that the case was fabricated and the call had no connection to Rana, who had no knowledge of it.
